      .id Placemaker website generated reports – disclaimers and copyright
       

      1. Report only for the Client and stated purpose

      This Report has been prepared by .id (Informed Decisions) Pty Ltd ACN 136 538 951 (”.id”) for the Client for the purpose as stated in the .id Placemaker Agreement.  The Report is prepared only for Client use and for no purpose other than the purpose stated in the .id Placemaker Agreement.  .id takes no responsibility for this Report or any part of it being used or relied upon by anyone other than the Client.  The Client is not authorised to give this Report to a third party without the consent of .id to do so.

      2. Report Content Disclaimer

      This Report may contain ABS Data, Forecast Data, Third Party Content and/or Client Content.  .id gives no warranty nor bears any liability whatsoever with respect to the correctness, accuracy, currency, completeness, or otherwise of any ABS Data, Forecast Data, Third Party Content, or Client Content contained within the Report.

      3. Forecast Data Disclaimer

      Where the Report includes Forecast Data (SAFi and third party), the Client acknowledges and accepts in respect of that Forecast Data that:

      1. although due care and attention is used by .id in the preparation of SAFi Data, forecasts by their very nature are subject to uncertainty and contingencies many of which are outside the control of .id;
      2. .id provides SAFi Data in good faith but the accuracy, relevancy and correctness of such SAFi Data is subject to variation as a result of changes in the ABS Data and other factors outside of the control of .id including environmental, political, legal and seasonal changes;
      3. actual future results may vary from Forecast Data and any variation may produce materially positive or negative future results, such results for which .id shall bear no liability whatsoever;
      4. by providing Forecast Data, .id should not be considered as giving a recommendation in relation to the subject matter of such Forecast Data.

      4. Client reliance on Report and content

      The Client acknowledges and accepts that:

      1. .id Placemaker has been designed in such a way so as to give a specific type of result from the .id Content based on the parameters for .id Placemaker specified by the Client;
      2. It remains the responsibility of the Client to check all results produced from .id Placemaker before use and to ensure that these results are suitable for the Client’s specific purpose and application;
      3. .id Placemaker enables the Client to choose how to aggregate geographical areas to produce aggregated demographic results and forecasts. How the Client selects the geographical areas for aggregation will impact on the results.  How the Client chooses to use .id Placemaker and .id Content and the assumptions underlying Forecasts and other demographic analyses require careful consideration by the Client and should only be used as one of the Client’s tools and/or processes for decision-making;
      4. in relation to Forecast Data, it should only be used in a scenario planning sense and is subject to the Client acknowledgements set out in clause 3 above;
      5. the Client should exercise reasonable judgment and care in its use of the Report and its content.

      5. Copyright

      5.1 This Report and all material contained within it is subject to Australian copyright law. Copyright in all such material [excluding ABS Data & other data or information where ownership by a third party is evident] is owned or licensed to .id. Other than in accordance with the Copyright Act 1968, the .id Placemaker Agreement or as specifically agreed between .id and the Client, no material from this Report may, in any form or by any means, be reproduced, stored in a retrieval system or transmitted. Any enquiries regarding the use of this Report should be directed to placemakerreports@id.com.au

      5.2 In relation Report content, .id advises:

      1. any ABS Data used and the copyright in the ABS Data remains the property of the Australian Bureau of Statistics. Reuse of ABS Data must comply with ABS copyright requirements [abs.gov.au]
      2. HERE Maps and the copyright in Here.com Maps remains the property of Here North America LLC, and reuse of this data must comply with the HERE Service Terms;
      3. any Third Party Content and the copyright in it, that is evident within the Report remains the property of the identified third party; and permission to reuse this data source must comply with the third party’s terms of use;
      4. any Forecast Data (SAFi) and the copyright in the Forecast Data remains the property of .id, and any use of the Forecast Data beyond use in the Client’s own internal reports, publications and presentations requires express prior written permission from .id. The Client must clearly cite .id as the source of the Forecast Data wherever Forecast Data is utilised; and
      5. in relation to third party Forecast Data .id makes no representation whatsoever that it has any ownership rights to this data or in any copyright associated with the data.

      5.3 Where the Client replicates the whole or any part of the Report (“the replicated work”), then the Client must clearly attribute the work of .id or any relevant third party content by including an Attribution Notice in the document or other medium where the replicated work is published. The Attribution Notice must be published in a place where it can be easily found and viewed by any reader or observer of the document or other medium in which the replicated work appears.

      5.4 Where the Client replicates a part of the Report that is a diagram, map, table, graph or data in another format and that source of data is already identified with the data source, then that attribution [including any logo] must be replicated along with the replicated work.

      5.5 The Attribution Notice must clearly show:

      • .id’s authorship of the Report, by inserting the following wording with a live hyperlink to www.id.com.au  For example:

      ‘Compiled and presented by .id – the population experts  www.id.com.au‘

      or

      ‘Sourced from .id – the population experts  www.id.com.au‘

      • that the replicated work is a derivative of ABS Data by inserting the following wording with a live hyperlink to http://www.abs.gov.au/
      • “This material is a derivative of ABS Data that can be accessed from the website of the Australian Bureau of Statistics at www.abs.gov.au, and which data can be licensed on terms published on the ABS website“
      • that any replication of identified third party data belongs to the identified owner or authorised licensee.  Any replication must comply with content or product terms of use published by the relevant third party.

      An example of an acceptable Attribution Notice is as follows:
      Much of the content of this report has been sourced from .id – the population experts  www.id.com.au
      .id and its licensors are the sole and exclusive owners of all rights, title and interest subsisting in that part of the Report content where .id or other content providers are identified.  Some of the .id sourced content
       is a derivative of ABS Data, which data can be accessed from the website of the Australian Bureau of Statistics at www.abs.gov.au, and licensed on terms published on the ABS website.

      6. Definitions and interpretation

      6.1 In this Agreement, unless the context otherwise requires:

      1. ABS Data means statistical census information collated, produced, supplied and/or owned by the Australian Bureau of Statistics and upon which .id relies to produce the .id Content in .id Placemaker. For the avoidance of doubt, although some .id Content is based on and/or derived from ABS Data, .id modifies, transforms and/or reconfigures such ABS Data in order to create, collate, compile, produce and supply some of the .id Content within .id Placemaker.
      2. Client Content (if any) means any data, information or other content belonging to, or licensed to the Client, which the Client provides to .id for the purpose of incorporating it into, or informing, the Client customised .id Placemaker.
      3. Forecast Data is a reference to both SAFi Data and forecast data provided by third parties for the Client customised .id Placemaker. SAFi Data is the data produced by .id for the Client within the forecasting parameters set by the Client.
      4. .id Content means any data, information or other content belonging to, or licensed to .id (including Third Party Content and Forecast Data);
      5. .id Placemaker means the web-based platform designed to analyse data spatially, where the data can include .id Content, Client Content and Third Party Content.
      6. .id Placemaker Agreement means the agreement entered into between .id and the Client pursuant to which .id created the Client customised .id Placemaker.
      7. Report means the report generated for the Client from the Client customised .id Placemaker.
      8. Third Party Content means content obtained by .id from a range of sources for use within .id Placemaker.
